Terms of Service
Last Updated: July 2026
1. Scope of Service
ITKX Cloud is a managed infrastructure and database operations service operated by ITKX Technologies. We provide technical configuration, operating system administration, backup supervision, database replication management, and monitoring services.
We are not a hosting provider. We do not provide physical servers, network hardware, domain registration, or DNS hosting. The scope of your specific service deliverables is governed entirely by your signed Service Level Agreement (SLA).
2. Customer Account Ownership
You must own and maintain all third-party cloud infrastructure accounts (e.g. AWS, OVHcloud, E2E Networks). You are directly responsible for paying all hosting, database usage, domain registration, DNS, SSL, and third-party license fees directly to those respective providers.
3. Operational Boundaries & Disclaimer
While our engineers implement industry best practices to secure and backup your systems, you acknowledge and agree that:
- Infrastructure stability and physical networking remain subject to third-party provider availability.
- We cannot promise that any setup is “100% secure” or will “never experience downtime.” Security management reduces risk but cannot eliminate all risk.
- Database Recovery Point Objectives (RPO) and Recovery Time Objectives (RTO) are technical estimates and require documented architectures and scheduled validations. We cannot offer a “guarantee of zero data loss” or “instant recovery.”
- Emergency support availability is dictated by your selected subscription plan.
4. Limitation of Liability
To the maximum extent permitted by law, ITKX Technologies and its engineers shall not be liable for any indirect, incidental, special, or consequential damages—including but not limited to loss of revenue, loss of data, or system downtime—arising from third-party hosting outages, physical disasters, or software bugs.
5. Governing Law
These terms are governed by the laws of India. Any legal disputes arising from these services shall be subject to the exclusive jurisdiction of the courts in Bangalore, India (or as defined in your SLA).
